HTC One launch vid disappears, but not before claiming it's 'everything your phone isn't'

We've commented before on how HTC always seems to come in second to Samsung -- not because it has inferior hardware, but because its marketing budget is comparable to what's fallen between the cushions of Sammy's sofa. We might have seen the start of a new strategy from HTC, however, as the company appears to have collaborated with Funny or Die on a comedic promo for the HTC One. It surfaced at the end of last week, but seems to have since been removed from the site. (It's possible HTC deliberately pulled it for some reason, and we've reached out for comment.) In the meantime, copies have found their way onto YouTube, and AdAge reports it'll start showing up on some websites today, and in a bunch of movie theaters from April 26th. A spoof of The Bachelorette, hosted by James Van Der Beek Dawson Leery, the clip depicts the leading lady deciding on her next handset, with the One winning out against feature-lacking peers -- or rather, people dressed in phone costumes. HTC even go as far as coining a bold tagline for the flagship: it's "everything your phone isn't." Whether it's actually funny is up to you, so check out the full skit below.

Officer accused of having Trayvon Martin target

(AP) ? A police officer accused of bringing targets resembling Trayvon Martin to a gun range has been fired.

Port Canaveral Interim Chief Executive Officer John Walsh told WFTV on Saturday (http://bit.ly/175m2lH ) that Sgt. Ron King was leading a target practice with two other Port Canaveral police officers and a civilian port employee when he pulled out the targets April 4. Walsh says King asked the group if they wanted to use the targets and they said no, telling King to put them back into his patrol car.

Port Canaveral is about 50 miles southeast of Sanford, where the 17-year-old Martin was killed in 2012 by neighborhood watch volunteer George Zimmerman.

Zimmerman says he shot Martin in self-defense. His trial is set for June.

'The Avengers' takes top prize at MTV Movie Awards

LOS ANGELES (AP) ? With a cast of superheroes and villains, "The Avengers" beat out its competitors to become the big winner at the MTV Movie Awards.

The action romp won three awards Sunday, including the top prize, movie of the year.

"What's the opposite of humbled? We're Biebered to be standing here," said "Avengers" writer-director Joss Whedon as he accepted the final golden popcorn trophy. "This is the award that means the most to me. I am so grateful and very excited for 2015; we're going to bring you 'Avengers 2.'"

"The Avengers" also won best fight and best villain for actor Tom Hiddleston.

Bradley Cooper and show host Rebel Wilson were each double winners at the ceremony at Sony Pictures Studios in Culver City, Calif. Cooper won the first prize of the night for his performance in "Silver Linings Playbook" and returned to the stage to accept best kiss honors for his smooch with co-star Jennifer Lawrence in that film.

Lawrence, who won the Oscar for her role in "Playbook," was also a double winner, though she wasn't on hand Sunday. In addition to the kiss award, she won the golden popcorn for her performance, but the prize wasn't presented on camera.

Wilson, who opened and closed the show wearing Iron Man-style armor, won breakthrough performance for her work in "Pitch Perfect" and shared in the film's award for best musical moment. Its stars, including Brittany Snow and Skylar Astin, opened the show with a mash-up medley.

Other musical acts were Macklemore & Ryan Lewis and Selena Gomez, who debuted her new song, "Come and Get It," with a Bollywood-inspired performance.

The MTV Movie Awards are as much about the anticipated movies of the upcoming summer season as they are about the finest films of last year. Fans vote online for the winners in traditional and irreverent categories such as best fight, best kiss and best shirtless performance.

"Twilight" heartthrob Taylor Lautner won the shirtless award.

The show also included new footage from next month's "Iron Man 3" and the world premiere of "The Hunger Games: Catching Fire" trailer, introduced by one of its stars, Liam Hemsworth.

Stars from other summer films? including Chris Pine, Zoe Saldana and Zachary Quinto from the "Star Trek" sequel and Vin Diesel and Michelle Rodriguez from the "Fast & Furious" franchise ? appeared as presenters during the ceremony.

Other presenters included Brad Pitt, Chris Rock, Adam Sandler, Seth Rogen, Zac Efron, Snoop Dogg/Lion and Kim Kardashian.

Hollywood has increasingly used the fan-driven MTV Movie Awards as a platform to promote its summer product. This year, the show was moved up from June to April to incorporate the entire blockbuster season, which begins in early May.

Honorees and presenters represent upcoming movies, and the ceremony is typically peppered with commercials for forthcoming films and DVD releases.

Emma Watson, a star of this summer's "The Bling Ring," received the Trailblazer Award.

Will Ferrell wore a three-piece suit covered in dollar bills to accept the Comedic Genius Award from "Game of Thrones" star Peter Dinklage.

"For those of you sitting here tonight who don't think I'm funny, I'll be happy to fight you in the parking lot after the show," said Ferrell, who is currently at work on "Anchorman 2," slated for release later this year.

Jamie Foxx was a double winner, too. He shared the best WTF moment award with Samuel L. Jackson for their scenes together in "Django Unchained," and later thanked his daughter, parents and siblings in the audience as he accepted the Generation Award for his career in film.

Foxx stars in June's "White House Down."

Seeking calm in Koreas, US looks again to China

BEIJING (AP) ? As North Korea prepares a potential missile test and issues threats almost daily, the Obama administration on Saturday looked again for China to force its unruly neighbor to stand down.

It's a strategy that has produced uneven results over decades of American diplomacy, during which Pyongyang has developed and tested nuclear weapons and repeatedly imperiled peace on the Korean peninsula.

But with only the counter-threat of overwhelming force to offer the North Koreans, the U.S. has little choice but to rely on Beijing to de-escalate tensions in a peaceful manner.

The question of how Washington can persuade Beijing to exert real pressure on Korean leader Kim Jong Un's unpredictable regime was front and center as U.S. Secretary of State John Kerry held a series of meetings with Chinese leaders in Beijing.

As they sat down together in China's Great Hall of the People, Kerry told President Xi Jinping that he looked forward to talking about the Korean situation. He later met Premier Li Keqiang and other top communist party figures.

The immediate crisis: a North Korean test of a mid-range missile with a range of up to 2,500 miles that the U.S. believes could happen any day. The long-term problem: a nuclear program that may soon ? or already ? include the capability to deliver a warhead on a missile.

China is the only country with significant leverage over North Korea, a regime that like few in the world actually cherishes its isolation.

The Chinese have dramatically boosted trade ties with their neighbors and maintain close military relations some six decades after they fought side by side in the Korean War. They provide the North with most of its fuel and much of its food aid.

But Beijing, which values stability in its region above all else, clearly has different priorities than Washington.

China's greatest fear is the implosion of North Korea's impoverished state and the resulting chaos that could cause, including possibly millions of refugees fleeing across the border into China.

For that reason, China has in many ways looked past North Korea's bellicose rhetoric and activity, prioritizing the security of Kim's regime ? like his father's and grandfather's previously ? over nuclear proliferation concerns.

"China's main interest in North Korea is not denuclearization; it is ensuring that the North Korean government does not fall," Asia expert John Pomfret wrote in a recent opinion piece.

"While Beijing might be exasperated with the Kim dynasty's uncanny ability to wag China's dog, China will support Pyongyang because the alternative, a North Korean collapse, is worse," he wrote. "While many South Koreans fear the cost of unification with their brothers to the north, China opposes that even more stridently."

China also remains deeply wary of any American military buildup in its backyard, suspicious that the containment effort toward North Korea may be part of the long-term U.S. strategy to expand its influence in the region and even ring in fast-growing China with countries closer to Washington.

U.S. officials say they've gone to great lengths to explain to China that the American objective in North Korea ? at least in the short term ? is not regime change.

While the U.S. abhors the North's human rights record, its regular provocations and military links with other international pariahs such as Iran, it has stressed over years of conversations with Beijing that pushing for North Korean denuclearization could reinforce stability.

In Seoul on Friday, Kerry said President Barack Obama had canceled a number of military exercises planned with South Korea. The message was directed as much to Pyongyang as Beijing that the U.S. wasn't seeking a military confrontation.

"I think we have lowered our rhetoric significantly and we are attempting to find a way for reasonableness to prevail here," Kerry told reporters. "We are seeking a partner to deal with in a rational and reasonable way."

The Obama administration believes it may now have greater scope for diplomatic progress.

It has pointed to Xi's recent criticism of Pyongyang as illustrative of a subtle shift in China's outlook. Beijing also has backed U.N. sanctions in response to North Korea's tests of a nuclear device and intercontinental ballistic missile technology over the last four months.

But, U.S. officials say, China has refused to stamp out business between its companies and North Korean entities under American sanctions. And it has failed to eliminate the flow of funds to North Korea's weapons of mass destruction program.

And even as North Korea has issued outlandish threats including nuclear strikes against the United States, American officials say they aren't even considering asking China to slow its burgeoning trade and investment ties with its neighbor.

The U.S. is in somewhat of a bind. It wants the Chinese to do its bidding, but it cannot push too hard, given that the U.S.-China relationship is of paramount importance to global security and the world economy. The U.S. and China are the world's two biggest economies.

On the one hand, U.S. officials blame China for continuing to provide North Korea protection for its provocations. Yet they also claim China's position is moving closer to the rest of the international community, even if that's had little impact on the North's behavior.

Pomfret pointed to President George W. Bush's memoir as a lesson of China's true objectives. Bush described how in October 2002 he invited then-President Jiang Zemin to his ranch and asked for China's help to prevent North Korea from developing nuclear weapons.

Jiang, Bush said, told the American leader that "North Korea was my problem, not his." Only when Bush threatened a military strike against the North did China react differently, Bush wrote.

Six-party denuclearization talks started soon after, but they didn't solve the problem. By 2006, North Korea was a nuclear power.

We probably shouldn't have been surprised when David Cope excitedly asked us if we'd like to see his new iPad app, as we began packing up our shoot for a forthcoming Engadget Show episode. After all, the former UC Santa Cruz music professor's name has, over the past several decades, become closely tied to the world of computer-generated music -- it figures that the journey that began with punch cards would have eventually led to tablets and smartphones.

Jambandit hit the App Store a couple of weeks ago. It's the first offering from Recombinant Inc., a small company co-founded by Cope in Santa Cruz a few years back as a "commercial extension of a body of [his] academic work." His time in the field began during one particularly bad bout with writer's block -- tasked with writing an opera, Cope eschewed traditional paths for the earnest development of a new system for creating music, working to create a software program that could generate scores in the styles of different composer -- a move that, unsurprisingly, opened up a slew of questions on the subject of creativity.

(AP) ? A former submarine commander who faked his death to end an extramarital affair should be honorably discharged from the Navy, a panel of officers recommended Friday after a daylong hearing in which the officer said he accepted "full and total accountability" for his behavior.

Cmdr. Michael P. Ward II, a married 43-year-old, sent his mistress in Virginia an email in July posing as a fictitious co-worker named Bob and saying Ward had died unexpectedly. Ward was relieved of his duties aboard the USS Pittsburgh in August a week after he'd taken command and has received a letter of reprimand for adultery and other military violations.

After testimony from Ward's former superior officers, colleagues and shipmates, Ward, in his dress blues, acknowledged to the panel that he had had an affair and sent the bogus email to the woman in an effort to end it.

"The reason I did it was to sever the relationship," he said, "but the choice was ridiculous."

He apologized to the Navy and the sailors who served under him.

The three-officer board of inquiry recommended Ward retain his rank upon being discharged. Its decision goes to the secretary of the Navy for approval within 90 days.

During the hearing, at Naval Submarine Base New London, the government countered that Ward discredited the Navy and that his removal put a strain on the fleet because officers had to be shuffled around to cover his removal.

"Commander Ward's actions show a complete lack of honesty, character and integrity," said Navy Lt. Griffin Farris, acting as prosecutor at the hearing.

Ward said he accepted responsibility for his actions and would regret them all his life, adding that he was grateful to his wife for standing by him.

"I want to apologize directly to my wife for the hurt and harm and humiliation I have caused her," he said as she sat in the front row, her eyes red. "I accept full and total accountability for my actions."

Still, the Navy shouldn't throw away Ward's talent and training, said high-ranking officers with whom he has served. They said he made an awful mistake and was a fast-rising, hardworking officer.

Before moving to Connecticut, Ward served on the Joint Chiefs of Staff, where he used his nuclear expertise to provide daily briefings to the chairman as the Fukushima disaster unfolded following the earthquake in Japan. Navy Capt. Lawrence Vincent, who worked with Ward in Washington, said he would serve with again and the handling of the affair struck him as out of character.

"With Mike Ward, it was a true shock," Vincent said.

Ward was honest with his chain of command from the beginning, his lawyer said.

"This man probably would have been an admiral someday, and he's brought shame on himself, and he knows that," said Navy Cmdr. Daniel Cimmino, representing Ward.

But a senior enlisted sailor from the USS Pittsburgh told the panel that Ward at first denied the accusations.

The sailor, Master Chief Chris Beauprez, said he received a call on the submarine from a sister of Ward's girlfriend, who told him what Ward had done.

Beauprez said he told Ward about the call and Ward denied the woman's allegations, then said he'd address the situation himself. Beauprez testified that he had an implicit trust in what his commander said so he didn't take the matter any further.

Days later, he said, he heard Ward was being dismissed.

A fellow Navy officer who had gone through training with Ward, Cmdr. Anthony Moore, testified that he heard about the affair, including the detail that Ward had used the name Tony Moore in an online dating profile that he used to meet the woman, when news of it first surfaced.

"I was very surprised," Moore, who's based on a submarine squadron in Washington state, told the board by telephone. "And frankly, I was a little concerned for my reputation."

Is North Korea on a 'collision' course with vow to restart nuclear reactor?

Kim Jong-un announced that North Korea will restart its nuclear facility, making the country's nuclear program a source of deep concern for the international community.

North Korean leader Kim Jong-un continued what has become a daily effort to raise tensions and fears abroad, and to consolidate patriotic ardor and unity at home, by saying he plans to restart an old nuclear reactor that can produce plutonium used in the creation of nuclear weapons.

In response, UN Secretary General Ban Ki-moon, the former foreign minister of South Korea, today described the North as on ?a collision course with the international community? ? even as some Korea watchers call it all bluster and bellicosity.

Experts say it could take as little as three months to a year for scientists to restart the Yongbyon nuclear facility. The facility?was closed most recently in 2012 with the promise of food aid from the US ? though that so-called "food for nukes" deal fell through with the North's third nuclear test in February. ?

It is quite unclear whether young leader Kim Jung-un ? whose recent bone-jarring threats of war and attack are considered part of his consolidation of power inside Pyongyang and among the North Korean people ? will go ahead with an expensive project of plutonium reprocessing and enriching uranium, or use these to extract aid and talks.

A nuclear weapon or capability has long been the No. 1 prize sought by the Kim family dynasty in Pyongyang, dating to Kim?s grandfather Kim Il-sung, as the ultimate bargaining chip both for its own security and as a means to gain international attention and aid. In February, the North successfully tested a device, that resulted in UN sanctions that the North has protested are undeserved.

The reclusive state declared a ?state of war? exists between the two Koreas last weekend, and last month vowed to target Hawaii and Guam with its rockets, though they are not currently thought capable of reaching US bases, nor are they nuclear-tipped.

The Associated Press writes today that:

A spokesman for the North's General Department of Atomic Energy said scientists will quickly begin work "readjusting and restarting" a uranium enrichment plant and a graphite-moderated, 5-megawatt reactor that could produce a bomb's worth of plutonium each year.

AP also quotes North Korean expert Hwang Jihwan at the University of Seoul, South Korea, who argues that Pyongyang?s recent behavior aims at?"keeping tension and crisis alive to raise stakes ahead of possible future talks with the United States."

Essentially, reports the AP, "North Korea is asking the world, `What are you going to do about this?' "

Complicating matters is the fact that Kim Jong-un was considered by Western officials a relative unknown until he took over from his father, ?Dear Leader? Kim Jong-il last spring. And still, not much is known about him.

Bluster or not, the North?s belligerence has put the Korean peninsula on high alert. Kim Jong-un has scratched the armistice signed after the Korean War, cut military hotlines, brought new South Korean president Park Geun-hye to say that the South will retaliate over any provocations, and caused the US military, which has 28,000 troops in the South, to relocate sensitive radars and to send B-2 Stealth bombers in fly overs.

Yet, the Los Angeles Times today points out:

After the declaration of a "state of war" over the weekend, the White House said no major troop movements were detected in North Korea. White House officials have said the Pyongyang regime has shown no "action to back up the rhetoric."

The?U.S. Navy, however, is moving a sea-based radar platform closer to North Korea to track possible missile launches, a?Pentagon?official said Monday. The support is the latest step to deter the North and reassure South Korea and Japan that the U.S. is committed to their defense.

In one sense, Korea watchers say, the new regime is simply rehashing and upping the volume of an ideology and a language that the North and the Kim family have used for many years to remain in power and keep people unified by the threat of an enemy.?

Being taken seriously by the outside world is an important verification of the Kim regime, which feeds edited broadcasts of world media to its people, whose sources of information are carefully controlled.

US intelligence chief: Cyberterror leading threat

WASHINGTON (AP) ? The top U.S. intelligence official says cyberterrorism is the leading worldwide threat to U.S. security.

James Clapper is director of national intelligence. He's telling Congress Thursday that cyberattacks and cyberspying can damage critical infrastructure like power grids. But in prepared testimony, he says advanced cyber-actors like Russia and China are unlikely to launch such attacks unless they are threatened by conflict.

He gives examples like last year's denial-of-service attacks on websites for U.S. financial institutions, and the attack against 30,000 computers at Saudi oil company Aramco, as typical of what's to come.

Clapper also says al-Qaida and its offshoots will continue to plot attacks on U.S. targets. He warns that the Arab Spring revolt has produced a spike in threats, and that Iran continues to present a danger.

(AP) ? The bickering parents of Broadway's most expensive show have made up ? in court at least ? and that removes a huge cloud above the future of "Spider-Man: Turn Off the Dark."

Producers and fired director Julie Taymor hashed out a settlement that was announced Wednesday, and both sides released statements hoping the superhero show could now soar beyond Broadway.

Taymor, the original "Spider-Man" director and co-book writer, was fired in 2011 after years of delays, accidents and critical backlash to a show whose price tag ballooned to $75 million.

Taymor slapped the producers, led by Michael Cohl and Jeremiah J. Harris, as well as Glen Berger, her former co-book writer, with a federal copyright infringement lawsuit, alleging they violated her creative rights and hadn't compensated her for the work she put into the show. The producers' filed a counterclaim asserting the copyright claims were baseless.

Though settlement talks had been ongoing, a final deal hadn't been hammered out, and Manhattan federal Judge Katherine Forrest had set a May 27 trial date, which has now been made moot.

The settlement means a legal quagmire has been removed and frees producers to consider options, including a tour or a new home for the show if it ever needs to leave Broadway. No details about the settlement or how it was reached were revealed.

It was clear that prolonged and embarrassing court hearings would further injure the property. Taymor, in a statement, said she had hope "for the continued success of Spider-Man, both on Broadway and beyond." The producers said they looked forward to spreading the show "in new and exciting ways around the world."

The show, which features music by U2's Bono and The Edge, opened in November 2010 but spent months in previews and then retooling before officially opening a few days after the Tony Awards in June 2011. It has become a financial hit at the box office.

Taymor's lawsuit sought half of all profits derived from the sale, license, transfer or lease of any rights in the original "Spider-Man" book along with a permanent ban of the use of her name or likeness in connection with a documentary film that was made of the birth of the musical without her consent.

It also sought a jury trial to determine her share of profits from the unauthorized use of her version of the superhero story, which it said was believed to be in excess of $1 million.

In the run-up to a legal showdown, papers revealed a behind-the-scenes atmosphere that was secretive and slightly paranoid. Taymor alleged that Berger was told to quietly work on changes to the story without Taymor's knowledge ? called "Plan X" ? that in an email Berger complained led him to lead a "double life" working with and against Taymor.

After Taymor left, writer Roberto Aguirre-Sacasa, director Philip William McKinley and choreographer Chase Brock cleaned up a story that had wandered into darker and mythological themes, while Bono and The Edge reworked the songs. More flying stunts were added, and the romance between Peter Parker and Mary Jane returned to center stage.

The use of four comic-book fans who framed the plot and represented Taymor, Bono, The Edge and Berger were cut. The role of a villainous spider-woman named Arachne was scaled back, and the Green Goblin's role was enhanced.

Taymor had alleged that the show hadn't been re-imagined after her firing and that what audiences are seeing at the Foxwoods Theatre is essentially the same show she directed.

On opening night, Taymor received a standing ovation and kisses from cast members, as well as from Bono and The Edge. The three were all smiles and posed for pictures together on the red carpet.

The stunt-heavy show has done brisk business since it opened its doors and most weeks easily grosses more than the $1.2 million the producers have indicated they need to reach to stay viable and pay off debts. But getting rid of a legal headache may open the door for more revenue options.
